The three Ashbys' able to walk grew weaker each day from the lack of food and the extra effort that the two sick boys made. The bore this burden with cheerful acceptance and with acts of loving kindness to all their fellow travelers. Only one-third of the company could walk and these were hauling the rest. The sun shone for a couple of days turning the road into a muddy slop that made gravel more difficult.
The sheriff at Vernal sent three deputies over Diamond Mountain. The three were (Jerry) Hatch Murray, Pete Dillman and a man named Thompson. After crossing Diamond Mountain and entering the valley, they met "Judge" Jack Bennett with three heavily loaded pack horses. Upon questioning Bennett, he told hem he was leaving the country and knew nothing about the Strang boy's killing. They placed him under arrest and continued toward the Bassett ranch. When they came to a gate with a cross bar overhead, they placed a rope around the "Judges" neck and hanged him.
